The conditions of Jihaad (Summarized) by Shaykh Muhammad Baazmool

Shaykh Muhammad bin ‘Umar Saalim al-Bazmool mentions in his book Dawaabit al Jihaad fee Kitaab was Sunnah that Jihaad is of two types:

النوع الأول : جهاد الدفع.

النوع الثاني: جهاد الطلب والدعوة

((The first type: Jihaad ad-Daf’ (defensive)

The second type: Jihaad at-Talab wad Da’wah (Offensive and Da’wah)))

He says:

فجهاد الدفع واجب متعين على كل من نزل العدو بأرضه.

أمّا جهاد الدعوة والطلب فإنه فرض كفاية، إذا قام به بعض المسلمين سقط عن الآخرين، فلا يتعين هذا النوع من الجهاد على كل أحد

((So Jihaad ad-Daf’ is waajib upon every individual upon who the enemies descend over their lands

As for Jihaad ad-Da’wah and at-Talab then it’s Fardh Kifaayah, if some muslims act upon it then the others do not have to, so this does not become an individual obligation upon every person))

Having said this, each of these two types has conditions.

1) The it must be in the Path of Allaah, which means making the Kalimah: There is nothing worthy of worship except Allaah the uppermost and the evidence is:

Surah al Anfaal from verse 39:

وَقَاتِلُوهُمْ حَتَّى لا تَكُونَ فِتْنَةٌ وَيَكُونَ الدِّينُ كُلُّهُ لِلَّهِ

And in the Hadeeth of Abee Moosaa al Ash’aree radhiallaahu anhu:

جَاءَ رَجُلٌ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: الرَّجُلُ يُقَاتِلُ حَمِيَّةً وَيُقَاتِلُ شَجَاعَةً وَيُقَاتِلُ رِيَاءً فَأَيُّ ذَلِكَ فِي سَبِيلِ اللَّهِ قَالَ: مَنْ قَاتَلَ لِتَكُونَ كَلِمَةُ اللَّهِ هِيَ الْعُلْيَا فَهُوَ فِي سَبِيلِ اللَّهِ

(Muntafaqun ‘Alaihi= meaning it’s been reported by Bukhaaree and Muslim)

2) Must have the ability and the means and the power

The evidence is in the statement of Allaah in Surah al Baqarah from verse 286:

لا يُكَلِّفُ اللَّهُ نَفْساً إِلَّا وُسْعَهَا

And Surah at-Talaaq from verse 7:

لا يُكَلِّفُ اللَّهُ نَفْساً إِلَّا مَا آتَاهَا

And Surah at-Taghaabun from verse 16:

فَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ

And for power the statement of Allaah in Surah al Anfaal: 60:

وَأَعِدُّوا لَهُمْ مَا اسْتَطَعْتُمْ مِنْ قُوَّةٍ وَمِنْ رِبَاطِ الْخَيْلِ تُرْهِبُونَ بِهِ عَدُوَّ اللَّهِ وَعَدُوَّكُمْ وَآخَرِينَ مِنْ دُونِهِمْ لا تَعْلَمُونَهُمُ اللَّهُ يَعْلَمُهُمْ وَمَا تُنْفِقُوا مِنْ شَيْءٍ فِي سَبِيلِ اللَّهِ يُوَفَّ إِلَيْكُمْ وَأَنْتُمْ لا تُظْلَمُونَ

And there are many evidences for this from the Qur’aan and Sunnah such as the lengthy Hadeeth about the Dajjaal and ‘Eesaa alaihis Salaam

3) The Permission of the Imaam

And the proof is the Hadeeth of Abee Hurayrah radhiallaahu anhu which is reported in Kitaab al Jihaad of Saheeh Bukhaaree:

مَنْ أَطَاعَنِي فَقَدْ أَطَاعَ اللَّهَ وَمَنْ عَصَانِي فَقَدْ عَصَى اللَّهَ وَمَنْ يُطِعْ الْأَمِيرَ فَقَدْ أَطَاعَنِي وَمَنْ يَعْصِ الْأَمِيرَ فَقَدْ عَصَانِي وَإِنَّمَا الْإِمَامُ جُنَّةٌ يُقَاتَلُ مِنْ وَرَائِهِ وَيُتَّقَى بِهِ فَإِنْ أَمَرَ بِتَقْوَى اللَّهِ وَعَدَلَ فَإِنَّ لَهُ بِذَلِكَ أَجْرًا وَإِنْ قَالَ بِغَيْرِهِ فَإِنَّ عَلَيْهِ مِنْهُ

And there are many evidences from the Sunnah and the statements of the Sahaabah and the Ulemaa of Islaam.

Shaykh Saaleh al-Fawzaan hafidhahullaah actually mentioned an evidence to us which Shaykh Muhammad Baazmool didn’t mention in the section of the permission of the Imaam:

From Surah at-Tawbah verse 38:

يا أيها الذين آمنوا ما لكم إذا قيل لكم انفروا في سبيل الله

And surah al-Baqarah verse 246:

َلَمْ تَرَ إِلَى الْمَلإٍ مِنْ بَنِي إِسْرَائِيلَ مِنْ بَعْدِ مُوسَى إِذْ قَالُوا لِنَبِيٍّ لَهُمْ ابْعَثْ لَنَا مَلِكاً نُقَاتِلْ فِي سَبِيلِ اللَّهِ

These are strong evidences for the requirement of the Imaam for Jihaad.

4) The permission of the parents

And the proof is in the well known Hadeeth of Ibn ‘Umar radhiallaahu anhumaa reported in Kitaab al Jihaad of Saheeh al Bukhaaree:

جَاءَ رَجُلٌ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَاسْتَأْذَنَهُ فِي الْجِهَادِ فَقَالَ: أَحَيٌّ وَالِدَاكَ؟ قَالَ: نَعَمْ! قَالَ: فَفِيهِمَا فَجَاهِدْ

And also the asbaab an-Nuzool of verse 22 of Surah al-Mujaadalah (Ibn Qudaamah reported this in his Mughnee 8/361)

    may Allah (swt) reward you, I guess with us womaen we have the tendancy to go over board with our emotions thus we wnat to act real fast😛

    Wa iyyake sister. Alhamdulillaah it clarifies the issue for you as many people today try to cause confusion on the issue and play around with the statements of the scholars in order to justify their slaughter and “jihaad”.

    Most of this Ummah is following emotions, that’s why we stick to the Qur’aan and Sunnah upon the understanding of the Sahaabah. may Allaah bless you and aid you.

    Abul Haarith, I wanted to hear what you have to say about the following:

    Does the offensive Jihad aim to put the whole world under the control of Muslims and kill ALL the (male) Mushrikeen (excluding the people of the Book) or does it just aim to control the whole world without killing ALL the (male) Mushrikeen?

    The famous 9:5 is used widely by the exegetes and past and (most) present scholars to imply the on-going slaughter of the Mushrikeen “whenever, and wherever” you find them.

    What is more strange is that they claim that this single verse abrogates about 200 verses of the Qur’an just because it was revealed after them all. Why can’t we look for a multi-dimensional interpretation of the verses instead of opting for an abrogation which wasn’t claimed by the Prophet (salla Allahu ‘alayhy wa sallam) himself? You know better than me that different people differed over whether a verse was abrogated or was an abrogator.

    If we claim this, then we are simply saying that there are about 200 verses (or I think 146?) of the Qur’an which are now of no use and you can just memorize them to obtain rewards but you cannot apply them because they are ALL abrogated by a single verse to “slay the(m)” Mushrikeen “wherever you find them”.

    I might sound a little offensive and disrespectful in what I just said but I do not intend so and it is the result of many readings I have done about this particular topic which has caused me to live in restlessness and discomfort. That is why I wanted to hear from you regarding this issue and whether ALL the (male) Mushrikeen are to be slaughtered or specific ones.

    I apologize for the lateness in response as I have not checked my wordpress in a while.

    The goal of “Offensive Jihaad” (Known as Jihaad at-Talab wad-Da’wah) is not to put the whole world under control of the Muslims and to kill all the Mushrikeen in a violent manner.

    The goal of Jihaad, whether it is Talab or Daf’, is to establish the word of Allaah (There is nothing worthy of worship except Allaah) as uppermost.

    And this does not require killing, hence the scholars say: wa ad Da’wah. As the fundamental principle is to call the people to Islaam upon gentleness and wisdom.

    The verse in Surah at-Tawbah which you mentioned: “Kill them wherever you find them” is often taken by the ignorant to mean that we take our swords and slaughter the mushrikeen and that we war with them whilst ignoring any other rulings which are put in place.

    But this is not the case as we can see from the application of this verse from the companions after the death of the Prophet salallaahu alaihi wa salam.

    Ad-Dahhaak reported that this verse abrogated the previous peace treaties with the Mushrikeen at the time of the Prophet salallaahu alaihi wa salam, as for the abrogation of 200 verses or so, then Allaahu A’lam. I have not read that in the Tafaaseer.

    The order to fight the Mushrikeen and the Kuffaar is not something which entails us to slaughter them mindlessly. And many of the scholars spoke in details about this particular issue. As there were Mushrikeen who lived under the rulership of the Muslims and they were not slaughtered.

    There is quite a bit of detail to discuss with regards to this issue. InshaAllaah when I have time I’ll try to gather more information from the scholars for you as right now I’m at work.
